Koforidua High Court Dismisses NPP Lawyer’s Request For Judge’s Recusal, Awards Cost Against Defendants

The Koforidua High Court has dealt a significant blow to the New Patriotic Party (NPP) and its candidate, Ernest Kumi, in the ongoing Akwatia 2024 parliamentary case.

 

In a recent ruling, the court dismissed an application filed by Gary Nimako, lawyer for NPP and Ernest Kumi, seeking the recusal of the trial judge from continuing to hear the matter.

 

According to the court, the trial judge cannot be on trial in his own court, and it is up to the Supreme Court to determine whether he should recuse himself.

 

This decision is a major setback for the NPP and Ernest Kumi, who had hoped to have the trial judge removed from the case.

 

To make matters worse for the defendants, the court awarded a cost of GHC 10,000 against Ernest Kumi in favor of the National Democratic Congress (NDC).

 

This ruling is a significant victory for the NDC, which had challenged the election results in the Akwatia constituency.

The Akwatia parliamentary seat has been a subject of controversy since the 2024 elections, with the NDC’s Henry Boakye-Yiadom contesting the results.

 

The Koforidua High Court had earlier issued an interim injunction preventing Ernest Kumi from being sworn in as the Member of Parliament-elect for the Akwatia constituency.

 

Speaking after the ruling, the lead counsel for the NDC’s legal team expressed satisfaction with the court’s decision, stating that it was a major step forward in their quest for justice. The case is expected to continue, with the NDC pushing for a rerun of the election in the Akwatia constituency.
