Akwatia: Henry Yiadom Boakye’s Counsel Clarifies Misinterpretation of Supreme Court Ruling On Ernest Kumi’s Contempt Case

The Supreme Court of Ghana has delivered its decision in a Certiorari application brought before it by Hon. Ernest Kumi, the Member of Parliament for Akwatia Constituency.

The application was filed in two parts, with suit numbers J5/24/2025 and J5/37/2025.

 

Outcome of the Decision
The Supreme Court unanimously dismissed some reliefs and granted others. Specifically, in suit number J5/24/2025, reliefs 1 and 2 were dismissed, while relief 3 was granted. In suit number J5/37/2025, reliefs 1, 2, and 3 were dismissed, while reliefs 4 and 5 were granted by a majority decision of 4-1.

It was reported that the Supreme Court has overturned the Koforidua High Court’s conviction of Ernest Yaw Kumi, the Member of Parliament for Akwatia, for contempt.

And also, the apex court has also nullified the execution of the bench warrant issued by Justice Emmanuel Senyo Amadehe following Mr Kumi’s conviction.

As a result, Justice Amadehe has been barred from sentencing Mr Kumi for the contempt charge.

 

 

Interpretation of the Decision

Meanwhile, Counsel for Henry Yiadom Boakye, who was the National Democratic Congress (NDC) 2024 Parliamentary candidate for the Akwatia Constituency, Bernard Bediako Baidoo Esq., has clarified that the decision does not quash the conviction of Ernest Kumi by the High Court, Koforidua, as some have misinterpreted.

Rather, he said that the Supreme Court prohibited the trial judge from proceeding to hear the matter forthwith.

 

“Unfortunately, we have taken note of the deliberate misinterpretation of the decision by our opponents to suggest that the Court has quashed the conviction of Ernest Kumi by the High Court, Koforidua. We wish to state that this is an incorrect interpretation of what the Supreme Court held this morning”.

“For the avoidance of doubt, the effect of the decision of the Supreme Court is that the validity of the Petition against Ernest Kumi was affirmed. Same as the conviction. What the court rather did was to rather prohibit the trial judge from proceeding to hear the matter forthwith”.

 

The counsel expects that the court’s reasoning, to be made available on July 2, 2025, may order a different judge to handle the sentencing of Ernest Kumi.

The counsel anticipates that Ernest Kumi may face charges of fraud and perjury after the Attorney General advises prosecution. The public is advised to disregard attempts to misinterpret the ruling and to cross-check with the reliefs filed in court.

 

“We therefore await the reasoning of the Supreme Court, where we anticipate an order to have a different judge deal with the sentence of Ernest Kumi. We hereby entreat the general public to disregard any such attempt to misinterpret the ruling of the Supreme Court and rather cross-check with the reliefs filed in court”.

“In the meantime, as we await the reasoning of the court, we wish to say that we are gratified by the said ruling in the sense that, by dismissing reliefs 1 in the J24 suit and relief 1 of the J37 suit, the court has confirmed our gazette notification filed in this case and has called into question the purported gazette notification filed by Ernest Kumi. Hopefully, Ernest Kumi shall be answering to charges of fraud and perjury, after the Attorney General has advised his prosecution”.
