JUSAG Blasts Special Prosecutor

The Judicial Service Staff Association of Ghana (JUSAG) has responded to comments made by Special Prosecutor Kissi Agyebeng about the performance of the judiciary regarding his work.

In a statement released on December 1, JUSAG said that there are “judicial avenues through which the concerns raised by the OSP can be legitimately addressed.”

The statement comes after Mr Agyebeng expressed concern about the number of “faulty judicial decisions” being made by the court which interfere with his work in corruption-related matters.

He also said that some courts are acting without or in excess of their jurisdiction, and that there is a misapplication or misinterpretation of the law.

The statement signed by JUSAG President, Samuel Afotey Otu said that Agyebeng should use the judicial system to challenge any decisions that he disagrees with.

“The cases were tried at the High Court, and if the SP disagrees or is dissatisfied with the decisions of the High Court, it could proceed to the Court of Appeal, and will still have the opportunity to appeal further to the Supreme Court for redress,” the statement said.

JUSAG also said that Agyebeng should support the judiciary to improve the justice system.

“The OSP and legal luminaries ought to support the Courts and the Judiciary to broaden the frontiers of the justice system through judicial review,” the statement said.

JUSAG emphasised that the “Courts do not exist to satisfy itself or the whims and caprices of any individual or state institution.”

“Indeed, justice emanates from the people and is exercised in the name of the Republic by the Judiciary which is independent, and subject only to the Constitution.”
